Damages Calculation
The process of determining how much money a harmed party should receive for a breach.
Plain English
Damages calculation is how courts figure out what amount of money will fairly compensate someone for losses caused by a broken contract or wrongdoing. There are different types: compensatory damages aim to put you back where you were before the breach, and consequential damages cover indirect losses you suffered. The goal is to make the injured party whole, not to punish the wrongdoer.
Example
You hire a caterer for your wedding who fails to show up. In damages calculation, the court would consider what you paid, what you spent on replacement catering, and any emotional distress or ruined event, then award a total amount to compensate you.
Used in a sentence
“The judge ordered damages calculation to determine how much the defendant owed for breach of the employment contract.”
