Actual Condition

In one sentence

The real state of something at a specific moment in time.

Plain English

An actual condition is simply how things really are right now, as opposed to how they're supposed to be or how someone claims they are. In contracts, this matters because parties often make promises based on what they believe the actual condition of something is. If you buy a used car and the seller says it runs great, but the actual condition is that the engine is broken, that gap between promise and reality can give you legal remedies.

Example

You agree to buy a house after the seller tells you the roof is in good shape. During inspection, you discover the actual condition is that the roof leaks badly and needs replacement. This difference between what was promised and the actual condition could allow you to back out or demand repairs.

Used in a sentence

The buyer sued because the actual condition of the merchandise was far worse than what the seller had described.
